By submitting the booking form, you acknowledge that you have read, understood and agree with the terms and conditions required by Wild Earth Expeditions Ltd.
Booking Conditions:
Please read the booking conditions as set out in your agreement with Wild Earth Expeditions Ltd (hereafter Wild Earth Expeditions) which will be quoted in US dollars and are inclusive of GST. All Wild Earth Expeditions’ scheduled expeditions are for all age groups who have sound levels of fitness as judged by a Medical Practitioner.
Wild Earth Expeditions Ltd Contract:
The booking conditions constitute a legally binding contract between Wild Earth Expeditions and the services provided by Wild Earth Expeditions.
By booking with Wild Earth Expeditions and paying the non-refundable deposit of USD$500 per client, per advertised trip, or full payment, you acknowledge that you have read, understood and agree to be legally bound by these booking conditions. Acceptance of your booking will be confirmed in writing and a contract becomes binding on the date shown on your confirmation letter or email.
If you do not understand any of the terms and conditions please feel free to discuss these with the director of Wild Earth Expeditions by email or phone as advertised on the website.
Prices:
Prices are based on cost and exchange rates applicable when the brochures and website were updated. Wild Earth Expeditions reserves the right to adjust prices whether or not you have made the full payment. Wild Earth Expeditions will do everything within its control not to adjust prices and will only adjust or amend prices in the unfortunate event of increased exchange rates, fuel cost (imposed on Wild Earth Expeditions) and other operating costs on which prices are based. Dates and itineraries departing in 2011 / 2012 are subject to change. Airfares, travel insurance, passport and visa fees, excess luggage charges, airport taxes, tips to guides and porters, extra meals (unless otherwise stated), laundry, drinks, medical expenses, optional extra activities or trips, and any items of a personal nature are not included in your trip price.
Amendments / Cancellations:
A deposit (as stated above) is due at the time of booking and the remaining balance due 60 days before departure unless otherwise arranged. If the balance is not paid by the due date Wild Earth Expeditions will regard the booking as cancelled. If cancellation is made more than 60 days prior to departure, the original deposit will be forfeited. If cancellation, which must be in writing is received after that time, the following scale of cancellation charges of the entire trip apply:
Days prior to departure:
Cancellation Fee in % to trip cost: 59 to 31 days 50% 30 days or less 100%. These charges are to cover the expenses incurred in advance preparation of trips booked.
Wild Earth Expeditions recommends that your insurance policy covers cancellation.
A fee of USD$150.00 will be charged for any changes or amendments and /or to transfer to another departure date of the same trip, up to 60 days before departure. Fees may apply on all trips that are cancelled. Name changes will be considered as a cancellation and the new name will be taken as a new booking. In this situation, all clauses referring to cancellation charges will apply. No amendments will be permitted 20 days before departure.
Late Bookings For bookings made within 15 days prior to departure Wild Earth Expeditions reserves the right to charge a late booking fee of $50 per booking. It is not possible to accept late bookings on some trips.
Land Cost Payment:
Wild Earth Expeditions’ trips involve a local land cost payment. This payment is the final payment before the beginning of your trip and is payable in a specified currency in cash as advertised in Wild Earth Expeditions brochures and websites. The local payment is payable in full, 30 days prior to departure. The local payment is non- refundable and is considered as part of the total tour payment. WILD EARTH EXPEDITIONS reserves the right to refuse your place on the booked trip if the local payment is not paid before commencement of the booked trip.
Cancellation of Trip by Wild Earth Expeditions:
Wild Earth Expeditions reserves the right to cancel a departure and will advise you of such cancellation no later than 30 days before the tour departure date. If, due to a chance adverse occurrence or government travel advice, Wild Earth Expeditions reserves the right to cancel a departure, including a guaranteed one, at any time. With any form of cancellation, Wild Earth Expeditions will offer you alternative arrangements, and keep to the price of Terms and conditions where possible.
If your alternative booking is of lower value than the original booking, Wild Earth Expeditions will refund the difference to you. If you do not accept alternative arrangements, Wild Earth Expeditions will refund all payments you have made to Wild Earth Expeditions, (in case of a chance occurrence or government travel advice, refunds will be less any unrecoverable costs). Wild Earth Expeditions will not be liable for any additional cost incurred by you for any damages or claims in connection with these cancellations.
Force Majeure:
Wild Earth Expeditions will not be liable for any delay in, change to or cancellation of trips due to “major catastrophe”. “Major catastrophe” means a circumstance beyond the reasonable control of Wild Earth Expeditions and includes, but is not limited to, war or threat of war, riot, civil strife, terrorist activity, industrial dispute, disease, industrial or nuclear disaster, adverse weather conditions, earthquakes, fire and strikes.
Changes to your holiday:
You acknowledge that travelling with Wild Earth Expeditions requires a degree of flexibility, good humour and an understanding that the itinerary accommodation, and / or modes of transport may change, even after a tour’s commencement, without prior notice due to local circumstances. Changes may occur because of “major catastrophe”, poor road conditions, weather, and the availability of tickets, vehicle breakdowns, changes in transport schedules, or other circumstances beyond Wild Earth Expeditions’ control or which simply cannot be foreseen. Wild Earth Expeditions does not accept any responsibility for loss of enjoyment, delays or compensation resulting from circumstances beyond Wild Earth Expeditions control. You acknowledge that group sizes may also vary during the duration of the tour.
The information about trips given in any brochures, trip notes and pre-departure information is subject to change. It is your responsibility to review up- to – date trip notes and pre-departure information. These can be obtained from the Wild Earth Expeditions website. The information and conditions in the trip notes and pre-departure information are deemed to be part of the contract. Where changes to your trip occur after you have received your final documentation, we will, where practical, advise you or your agent of such changes.
Health and fitness:
Wild Earth Expeditions recommends that the supplied exercise schedule (which is supplied on conformation by Wild Earth Expeditions), is followed prior to commencing any trip (see trip grading) and associated suggested exercise plan. If you suffer from severe muscular pain, chest, heart, asthmatic, or bronchial disorders, or have high blood pressure you are advised against coming on Wild Earth Expeditions trips.
All travellers will be required to obtain a medical certificate of fitness. If you fail your medical, a full refund of the deposit paid will be made, providing the medical as requested by Wild Earth Expeditions is returned within two weeks of booking.
Please note: Discovery of any undisclosed medical conditions will result in you being asked to leave the trip and will invalidate most insurance policies.
Wild Earth Expeditions reserves the right to cancel your participation in a trip at any time after trip commencement with no right of refund if your medical condition and/or disability could reasonably affect the trip and the enjoyment of other trip members.
Travel Insurance:
Personal travel insurance is not included in the tour/trip price. While every effort is made to ensure the safety for all, it is compulsory and a condition of Wild Earth Expeditions terms and conditions of accepting you on a trip, that you have personal travel insurance that is adequate to cover you for any event. Your travel insurance must cover accidents, injury, illness and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation (including helicopter rescue and air ambulance where applicable) and personal liability. Wild Earth Expeditions also recommends it covers cancellation, curtailment and loss of luggage and personal effects. You must carry proof of insurance and produce it if reasonably requested by Wild Earth Expeditions employees or suppliers. Wild Earth Expeditions reserves the right to cancel or suspend you participation on a trip or in certain activities that comprise part of a trip, at any time, including after the commencement of your tour, with no right of refund, if you are unable to provide proof of insurance when requested.
Passports and Visa:
You must carry a valid passport and have a valid visa (if a paper visa for the specific country is required) for your booked trip when travelling with Wild Earth Expeditions. Please ensure your passport is valid for 6 months beyond the duration of the trips. It is your responsibility to ensure you have the appropriate visas for your holiday. Wild Earth Expeditions cannot accept responsibility if you are refused entry to a country because you do not have the correct visa and passport documents.
Assumption of Risk:
Wild Earth Expeditions operate trips in regions where accommodation, safety, hygiene, medical facilities, and the infrastructure may not be of the standard that you are used to.
When booking with Wild Earth Expeditions you acknowledge and accept that participation in some of Wild Earth Expeditions trips involves an element that may not be present in trips of less demanding and conventional type holidays.
These risks could include the possibility of injury, death, disease, damage to property, psychological trauma, inconvenience and discomfort. With the participation of trips with Wild Earth Expeditions, there is the possibility of experiencing some or all of these risks when visiting unstable, remote, regions or regions where there is altitude or wildlife.
Terms and conditions 2019 / 2020 Wild Earth Expeditions Ltd.
While every effort will be made to ensure your safety and follow Wild Earth Expeditions itineraries, in the event of political problems or natural difficulties which are beyond Wild Earth Expeditions control and prevent our travelling to a particular area, Wild Earth Expeditions reserves the right to substitute an alternative activity for that section of the trip. The cost of any such changes or delays shall not be the responsibility of agents or Wild Earth Expeditions. By accepting Wild Earth Expeditions terms and conditions you acknowledge your decision to travel on a Wild Earth Expeditions trip is made after you have considered all relevant travel information supplied by Wild Earth Expeditions and travel advice provided at any time by government bodies and associated agencies.
Waiver of Liability of Wild Earth Expeditions Ltd
You acknowledge by accepting the terms and conditions of Wild Earth Expeditions that the enjoyment and excitement of adventure travel are derived in part from the risks in travel and activity beyond the accepted safety of life at home or work and that these contribute to such enjoyment and excitement, and are a reason for your participation.
You further agree to that if you suffer injury or illness, Wild Earth Expeditions can at any cost, arrange medical treatment and emergency evacuation service, as they deem essential for your safety, on your behalf. In entering into this agreement you are not relying on any oral, written or visual representatives or statements by Wild Earth Expeditions or its staff or any other inducement or coercion to go on the adventure trip, but entirely of your own free will. By ticking or signing the acceptance and acknowledgement of understanding Wild Earth Expeditions terms and conditions, you confirm that you accept liability for loss, injury, death, or damage, however, caused which you may directly or indirectly suffer in connection with your trip within the extent permitted by law.
By accepting Wild Earth Expeditions terms and conditions you also waiver any and all claims you may now and in the future have against, and release from all liability Wild Earth Expeditions, its service agents, independent contractors, employees, guides, porters, agents or representatives or the licensor for any personal injury, death, property damage, or loss you may sub stain as a result of participation in an adventure trip with Wild Earth Expeditions, its staff or licensor.
You also accept the need for physical exertion and that the weather extremes are subject to sudden unexpected change, remoteness from normal medical services and evacuation and its difficulties if you are disabled.
Wild Earth Expeditions’ Services and Obligations:
IA supply services consisting of arranging and coordinating adventure trekking travel, facilities and services and making bookings. Wild Earth Expeditions undertake to perform these services with reasonable care and skill and will not be liable for any loss or damage which results from the act, default or omission of any person other than Wild Earth Expeditions or any cause independent of human control.
Wild Earth Expeditions will endeavour to provide the most suitable services and trekking arrangements to meet the particular requirements of any given trip. However travel is an individual experience, and your preferences and opinions may vary from Wild Earth Expeditions. For this reason, Wild Earth Expeditions cannot take responsibility for your individual satisfaction.
Governing Law:
This contract and all provision of the services and matters arising from it are governed by and in accordance with New Zealand law and any dispute arising will be subject to the New Zealand Court procedures.
Promotional Material:
Wild Earth Expeditions reserves the right to take photographs of participants of a tour and these photographs may be used for promotional purposes. Participants, who would prefer their image not be used, must let the tour leader know this at the commencement of a trip on day one when the tour group meets for the first time.
